The instant petition is against the order dated 15.05.2017 whereby the arrest warrant has been issued by the Court below against the petitioner.

Learned counsel for the petitioner submits that there are four accused in this case and two accused have appeared before the Court and thereafter has been released. The petitioner may be given some liberty so that he may also appear before the Court and similar consequential order may be passed as has been passed in case of other co-accused who have been enlarged on bail subsequently.

Perused the order sheet. Perusal of the order sheet would show that on 23.05.2017 two of the other co-accused have appeared before the Court and having preferred the application for bail, they were released on bail. It is not in dispute that the petitioner was on bail before the arrest warrant was issued on 15.05.2017. In such circumstances, it is
directed that the petitioner may appear before the Court on the next date of hearing and on that date, the petitioner, if so advised, may prefer an application for bail, the same may be considered on the same day by taking into consideration that the similarly placed coaccused have been enlarged on bail by cancellation of the arrest warrant dated 23.05.2017.
