The petitioner in the instant case, is aggrieved by the inaction on the part of respondent No. 5 & 6 so far as non-releasing of the salary for the month of June, 2003 to September, 2006 and further, non-granting of the gratuity and other monetary benefits, which the petitioner claims that he has not been paid in the past.

Considering on the facts that the petitioner was substantively an employee governed by the provisions of the Cooperative Societies Act and his service conditions are regulated under the rules and regulations framed therein. The proper forum for the petitioner for raising his grievances, would be the authority prescribed under the Cooperative Societies Act. 3.

Let the petitioner approach the concerned authority under the Cooperative Societies Act in respect of his grievances and on such application being made, the authority concerned is expected to take a decision on the claim of the petitioner at the earliest in accordance with law. It is also expected that the authority concerned shall consider and decide the case at the earliest taking into consideration the fact that the petitioner is more than 70 years of age and has retired around 13 years back.
