Hon'ble Shri Justice P. Sam Koshy Order on Board 01/02/2019 1.

The grievance of the petitioner in the instant Writ Petition is that, the petitioner though has been working with the respondents prior to 1997 till date has not been regularized.

2.

The contention of the counsel for the petitioner is that, the respondent authorities meanwhile have regularized many of the similarly placed persons. He further contended that, the case of the petitioner earlier was considered, but for want of certain documents, his case could not be considered and his name was kept in abeyance. Meanwhile, the petitioner

under the Right To Information Act, 2005 has obtained those documents and have furnished it with the respondents, but yet they have not considered the case of the petitioner for regularization. The petitioner in his pleading has also compared his case with another employee namely Deepak Bhalerao whose name was also kept in abeyance and who has subsequently been regularized.

3.

Taking all these facts and circumstances into consideration, the present Writ Petition stands disposed off with a direction to the respondent No.3 to take a decision on the case of the petitioner for regularization at the earliest preferably within a period of 90 days from today. 4.

While considering the case of the petitioner, they shall also consider comparing the petitioner with similarly placed persons who have already been regularized by the department.

5.

The Writ Petition accordingly stands disposed off. Sd/- (P. Sam Koshy) Sumit JUDGE
