1) The applicant has preferred this application under Section 439 of Code of Criminal Procedure, 1973, as he was arrested on 18.01.2021 in connection with Crime No. 33/2021 for offence under Section 34 (2) of C.G. Excise Act, registered at Police Station- Gobra Navapara, District- Raipur (C.G.).

2) At the outset, learned counsel appearing for the applicant seeks to withdraw this application with liberty to file a fresh application if the trial is not concluded within a period of two months from today.

3) Counsel for the State has no objection to the above prayer.

4) Permission granted.

5) Accordingly, the application is dismissed as withdrawn with the liberty as stated above.
