The challenge in this petition is to the order dated 25.12.2018 (Annexure P/1) whereby the petitioner has been inflicted with punishment of stoppage of one annual increment without cumulative effect. 2.
The petitioner is to retire from service in the month of December, 2019. The limited relief that the petitioner has sought for is that the petitioner may be permitted to file an appeal before the appellate authority and the appellate authority, in turn, may consider the facts that the petitioner is retiring in this year itself and decide the appeal at the earliest. 3.
Given the said facts, this court does not intent to keep this petition pending any further, rather ends of justice would meet if this petition is disposed of with a direction that the petitioner may prefer an appeal against the order dated 25.12.2018 in addition to the representation that he has already preferred. Subject to the petitioner's filing fresh appeal within a period of two weeks from the date of receipt of certified copy of this order, the appellate authority, in turn, shall decide the appeal within a further period of 90 days from the date of receipt of fresh appeal by the petitioner. 4.
Accordingly the petition stands disposed of.
