Heard both the parties for further proceedings as to whether any contempt is made out by the respondents in the light of order dated 26.02.2013 passed by the writ court in Writ Petition No.4097/98 (NB Mitra Vs. State of MP& Ors.) and order dated 08.4.2013 passed in MCC No.219/13. regarding correction of the original order. 3.

In reply, it has been submitted that the respondents have considered and passed appropriate order in accordance with law on the merits of the matter.

On due consideration and after perusal of the entire material available including the petition and reply to the contempt petition, in the

considered view of this Court, the petitioner has failed to demonstrate that the respondents have committed contempt against the order passed on 26.02.2013. With this, this Court is not inclined to proceed further in the matter.

Consequently, contempt petition is dismissed, however the petitioner may file suitable writ application after the orders passed by the respondents before the writ Court, if he so advised. Sd/- (Chandra Bhushan Bajpai) JUDGE Bini
