The challenge in the present writ petition is to the order of transfer passed by the respondent No. 2 transferring the petitioner from Adiwasi Balak Ashram Mohli, Block Kota to Government Primary School, Pandripani, Block Gourella, District Bilaspur. However the petitioner, when the order was passed was infact working at the Government Middle School, Khongsara, Block Kota. District Bilaspur.

There was a direction on 21/12/2016 permitting the petitioner to continue to work as the School at Khongsara, Block Kota, District Bilaspur. By virtue of the interim protection that the petitioner has, the impugned order so far as the petitioner is concerned, has lost its efficacy. 3.

Accordingly the present writ petition stands disposed off with direction to respondents that they shall not act upon the order of transfer any further so far as the petitioner is concerned. However, the respondents shall be at liberty to pass fresh order of transfer in case administrative exigency so requires. 4.
