The applicant is apprehending his arrest in connection with Crime No.111/2019 registered at police station-Chhura, District- Gariyaband (C.G.) for alleged commission of offence under Section 379, 411 & 34 of Indian Penal Code.

The applicant along with two other co-accused persons have allegedly committed theft of tractor-trolley along with loaded centring articles. 3.
Co-accused persons have been arrested and released on regular bail. Recovery of the stolen property has already been made from them. 4.
Learned State Counsel would oppose the prayer for grant of bail. However, he would submit that apart from the present offence no other offence of similar nature have been reported against the applicant. 5.
Taking into consideration that in the same transaction of theft, relating to another tractor-trolley, in Crime No.139/2019, applicant has been granted anticipatory bail on similar considerations, in order to maintain parity, this Court
is also inclined to release the applicant on anticipatory bail. 6.
Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (a) he shall make himself available for interrogation by a police officer as and when required;
(b) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer. Sd/- (Manindra Mohan Shrivastava) Judge Ravi
