Hon'ble Shri Justice Manindra Mohan Shrivastava Order On Board 30/07/2021 Application for grant of bail has been moved mainly on the ground of delay in trial.
It is submitted that trial has not been concluded till date and the appellant has remained in jail since 31/07/2019.

Learned counsel for the appellant submits that even now about four prosecution witnesses remained to be examined. It is submitted that the appellant has remained in jail for two years and the trial has not been concluded till date. 3.
Learned State counsel opposes bail application. 4.
Considering the present situation and at the same time, taking into consideration the nature of allegations against the applicant where the applicant is alleged to have committed rape on a minor, instead of granting bail, it would be proper to direct early conclusion of trial.
In case, the trial is not concluded in the next four months, this Court may consider application for grant of bail only on this ground.

This application is, therefore, rejected with liberty to revive after four months. A copy of this order be sent to the concerned Trial Court forthwith for conclusion of trial at the earliest by giving priority.
