1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.139/2019, registered at Police Station Rajim, Dist. Gariyaband, for offence punishable under Section 379, 411 & 201 read with Section 34 of the Indian Penal Code.

2. The applicant along with two other co-accused persons have allegedly committed theft of tractor-trolley along with loaded centring articles.

3. Co-accused persons have been arrested and released on regular bail. Recovery of the stolen property has already been made from them.

4. Learned State Counsel would oppose the prayer for grant of bail. However, she would submit that apart from the present ofence no other offence of similar nature have been reported against the applicant.

5. Considering the facts situation of the case, this Court is inclined to release the applicant on anticipatory bail.

6. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of Rs.50,000/- (Rupees Fifty Thousand Only) with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (a) he shall make himself available for interrogation by a police officer as and when required;

(b) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
