Learned counsel for the appellant submits that the parties have entered into compromise, therefore, the decree be drawn according to the Batwaranama and the appellant do not want to further prosecute this appeal.

In view of the submission made, after perusal of the Batwaranama, it appears that the compromise has been arrived at and prima facie it appears that it is without any coercion and undue influence subject to just exception. Accordingly, the appeal is disposed of in terms of the compromise arrived at in between the parties.

Accordingly, the decree be drawn in terms of the Batwaranama, which is attached alongwith the compromise petition. Batwaranama would be the part of the decree.
