The Respondent has filed an application (I.A. No.1 of 2016) seeking permission of this Court to compound the offence. The complaint was filed by Shri Rajeev Agrawal against the Respondent under Section 506 Part-II of the IPC. Alongwith this application, deed of mutual settlement has been filed, in which both the Respondent and complainant alongwith others are parties and in the said agreement, it is mentioned that parties have lodged First Information Report against each other and those are also settled by means of this agreement.

The offence is compoundable and the accused has already been acquitted. The State has filed this appeal against the order of acquittal. It is apparent that the complainant does not want to continue with the case. Therefore, I allow the application and the appeal is accordingly dismissed. Sd/- (Deepak Gupta) Chief Justice Anu
