Agrawal Order On Board 31/01/2018 (1) Learned counsel appearing for the petitioner would submit that the petitioner has been suspended from service by respondent No.3 vide order dated 12.05.2017, which is unsustainable and bad in law. He would further submit that the petitioner's suspension is liable to be revoked in the light of the decision of Supreme Court in the matter of Ajay Kumar Choudhary Vs. Union of India through its Secretary and another reported in (2015) 7 SCC 291.
(2) Be that as it may, the petitioner is at liberty to make
representation along with relevant judgments of Supreme Court in support of his case to the respondent No.2 within a period of two weeks from today. If such representation is filed by the petitioner before the respondent No.2, in that event respondent No.2 shall consider and decide the representation of the petitioner in accordance with law expeditiously within a period of 30 days from the date of filing of such representation.
(3) With the aforesaid observation, the writ petition stands finally disposed of. No order as to cost(s).
