1. The applicant has preferred this application for grant of anticipatory bail, as he apprehends his arrest in connection with Crime No.333/2019, registered at Police Station Baradwar District Janjgir - Champa C.G. for offence punishable under Section 498-A, 34 of the IPC.
2. Applicant was married with the complainant on 19.04.2018.
MCRCA No. 160 of 2020 He has moved a divorce petition in January, 2019 and thereafter the present FIR has been lodged on 15.12.2019.
3. In the present complaint, there are allegations of demand of dowry, however, considering the fact that the FIR has been lodged after filing of divorce petition by the applicant, this Court deems it appropriate that the applicant be released on anticipatory bail.
4. Accordingly, the application is allowed and it is directed that in the event of arrest of the applicant, he shall be released on anticipatory bail on his executing a personal bond for a sum of ₹ 50,000/- with one surety in the like sum to the satisfaction of the arresting officer with the following conditions:- (I) he shall make himself available for interrogation by a police officer as and when required;
(ii) he shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the Court or to any police officer.
