Learned counsel for the petitioner seeks permission of the Court to withdraw the writ petition with liberty to prefer an appeal challenging the impugned order of suspension dated 23.07.2012 passed by the Commissioner, Surguja Division. He would submit that interim order passed by this Court may be allowed to continue during pendency of the appeal.

The petitioner is permitted to withdraw the writ petition with liberty to prefer an appeal under Rule 23 of the Chhattisgarh Civil Services (Classification, Control and Appeal) Rules, 1966. If such an appeal is preferred within one month from today, the Appellate Authority shall consider and decide the appeal on its own merits within further period of three months. Till the petitioner's appeal is considered and decided by the Appellate Authority, the interim order passed by this Court on 03.10.2012 shall remain in operation in favour of the petitioner.
