The learned counsel for the Income Tax Department submits that, pending the petition before this Court, the assessing authority has already passed the final assessment order against the petitioner. 2.

The said fact is not disputed by the learned counsel for the petitioner. 3.

At this stage, the counsel for the petitioner submits that, since, the final assessment orders have already been passed, he be permitted to withdraw the present Writ Petition with liberty to challenge the subsequent development.

In view of the submission made by the counsel for the petitioner, the present Writ Petition stands dismissed as having become infructous with the aforesaid liberty.
