Mr. S. K. Guha, Advocate For State :
Mr. Arvind Dubey, P.L.
Hon'ble Shri Justice P. Sam Koshy Order on Board 30/01/2019
1. The only grievance which has been raised by the petitioner in the present writ petition is that the petitioner has not been provided subsistence allowance that he is otherwise entitled for the period during which he was placed under suspension.
2. Counsel for the petitioner submits that the petitioner has already made a representation Annexure P-3 dated 16.07.2018 and the said representation till date has not been decided.
-23. Given the fact, this Court is of the opinion that no fruitful purpose would be served in keeping the petition pending, rather ends of justice would meet if the writ petition is disposed of with a direction to respondents 2 & 3 to take an appropriate decision as regards the subsistence allowance that the petitioner would be entitled for during the suspension period and to pass an appropriate order at the earliest preferably within a period of 3 months from the date of receipt of copy of this order. It is ordered accordingly.
4. The petitioner, in addition, would be entitled for making a fresh representation to respondent no.2 if he so prefers. It shall be the responsibility of the petitioner to apprise respondents 2 & 3 so far as the order passed by this Court is concerned.
5. The writ petition thus stands disposed of. S Sd/- (P. Sam Koshy) Judge Khatai
