Vide order dated 21.06.2016, the learned Single Judge dismissed the Writ Application giving liberty to the appellant who was the petitioner before the Writ Court to move the Industrial Tribunal, Jabalpur for execution of the award.

The view taken by the learned Single Judge that the award of the Industrial Tribunal would be required to be executed within the framework of the Industrial Dispute Act cannot be said to be an erroneous view to take. Further we would like to add that we are not the executing agency
wa 368 of 2016 or court for implementation or execution of the award of the Industrial Court specially when enough provisions are available within the framework of the statute in this regard.
