1. This petition has been brought praying for issuance of direction to the trial Court for expeditious disposal of the M.J.C. No.07/2019.
2. It is submitted by the learned counsel for the petitioner that this Court had, while disposing off W.P.(227) No.438 of 2019 vide order dated 10.02.2020, directed the Court concerned to conclude the proceeding on the application filed by the petitioner under Order 9 Rule 13 of C.P.C. within a period of two months and protection order was also passed in favour of the petitioner.
3. It is further submitted that at present, the learned Court has taken up the case for hearing on 06.01.2021 and passed orders for calling of records. The only prayer from the petitioner side is this that the direction be issued for disposing off the case within a time frame.
4. Learned counsel appearing for respondent No.06 has no objection.
5. Considering that already there is an order of this Court for disposing off the M.J.C. No.07/2019 within a time frame and the same had not been possible because of the pandemic situation so far and the suspension of normal functioning of this Court, therefore, the petition is disposed off at the motion stage and learned Court is directed to dispose off the application under Order 9 Rule 13 of C.P.C. which is filed as M.J.C. No.07/2019 within a period of one month from the date this order is passed.
