Hon'ble Shri Justice Rajendra Chandra Singh Samant Order on Board 03-02-2020 Heard.

1. This petition has been brought being aggrieved by the order dated 11.11.2019 passed by the Court of District Judge, Raipur, DistrictRaipur, C.G., in Civil M.J.C. Case No.89/2018, by allowing the application for condonation of delay.

2. Learned counsel for the petitioner submits that the respondent party has filed a review petition against the award passed by the National Lok Adalat, with application for condonation of delay and considered on the same. Therefore, the proceeding is totally beyond jurisdiction.

3. Considered on the submissions and on perusal of the impugned order, it appears that at present, there is only an order on application for condonation of delay and time has been granted to the non-applicant for

-2filing a reply.

4. The issue that the learned District Judge does not have the jurisdiction to entertain the review petition is still alive and it is open for the petitioner to file such objection before the same Court which may be decided in accordance with law. Therefore, in view of this observation, this petition is disposed off at the motion stage. Liberty is granted to the petitioner to file objection before the Court below.
