Suraj Kumar v. State Of C.G.
NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR CRIMINAL APPEAL NO. 500 OF 2001 Suraj Kumar, S/o Dasrath Ganda, aged 19 years, R/o Village Manki, P.S. Basana, District Mahasamund (C.G.) ... Appellant
Versus
State of Chhattisgarh, through District Magistrate, Mahasamund (C.G.) ... Respondent For Appellant :
None.
For Respondent-State :
Mr. Lav Sharma, Panel Lawyer.
Hon'ble Shri Justice P. Sam Koshy Judgment on Board 09/11/2016 1.
None appeared for the Appellant even after the matter was called repeatedly for three consecutive days.
2.
Today, when the record is perused with the assistance of the Counsel for the State it is learnt that the Appellant in the instant case was arrested on 24.10.2000 and he was not enlarged on bail either during trial or during pendency of the present appeal and as such it appears that he has already undergone the entire jail sentence awarded to him and therefore perhaps he is not interested in contesting the appeal on merits. 3.
In view of the fact that the Appellant has not shown any interest in contesting the present appeal on merits, this Court is left with no other option but to dismiss the appeal in the light of the fact that the Appellant has undergone the entire jail sentence and is not showing any interest in contesting the appeal.
4.
The appeal stands accordingly dismissed.
