The petitioner has filed this petition challenging continuous of departmental enquiry mainly on the ground of pendency of criminal case. The case of the petitioner before this Court is that the allegation of fact constituting departmental enquiry and criminal charges are one and the same. However, now during the pendency of this petition, criminal case has been decided.

Learned counsel for petitioner submits that the petitioner has been acquitted from all the charges.

In view of the aforesaid development, now the departmental authority should take appropriate decision in the matter of departmental enquiry. 5.
