Agrawal Order On Board 31/01/2018 (1) By the order dated 16.11.2017 the Sub Divisional Officer, Sarangarh has removed the petitioner from the post of Sarpanch, Jalgarh, District Raigarh. Against that order, the petitioner has filed appeal before the Collector, Raigarh along with application for grant of interim relief. The Collector, Raigarh by order dated 04.12.2017 has dismissed the application for grant of interim relief, against which he has preferred revision before the Commissioner, Bilaspur Division, Bilaspur, the same has been rejected by the Commissioner by impugned order dated 12.12.2017.
(2) Feeling aggrieved against the order dated 12.12.2017, the instant writ petition under Article 226 of the Constitution of India has been filed by the petitioner.
(3) After hearing learned counsel for the petitioner, I do not find any good ground to entertain the instant writ petition, but taking into consideration that the petitioner has already removed from the post of Sarpanch, therefore in the interest of justice, it would be appropriate to direct the appellate authority to consider and decide the appeal of the petitioner in accordance with law after hearing the parties expeditiously within a period of two months from the date of receipt of certified copy of this order.
(4) With the aforesaid observation, the writ petition stands finally disposed of. No order as to costs.
