1. The accused/respondent has been acquitted of the charge under Section 436 of IPC vide judgment dated 19.11.2019 passed by the 1st Additional Sessions Judge, Sakti, District Janjgir Champa, C.G. in Sessions Trial No.31/2017.

2. The accused was sent for trial for committing mischief by setting ablaze the shop belonging to complainant PW-4 Devram Patel.

3. Neither PW-4 Devram Patel nor any other prosecution witness has seen the occurrence. PW-4 says that he lodged the report on suspicion. He has been declared hostile. No other witness has named the accused as the person responsible for setting ablaze the house of Devram Patel.

4. No case for grant of leave to appeal is made out.
