Apprehending arrest in connection with Crime No.167/2016 registered at Police Station -City Kotwali, Mungeli, District -Mungeli, (C.G.), for offences punishable under Sections 188, 147 of the Indian Penal Code.

2. It is submitted by learned counsel for the applicant that the applicant is innocent and he has been falsely implicated in this case, hence, it is prayed that the applicant may be enlarged on anticipatory bail.

3. Learned counsel for the State opposes the bail application and submits that the application is not maintainable as both the offences registered against the present applicant is bailable, hence, he is not entitled for grant of anticipatory bail.

4. Heard counsel for both the parties and perused the case diary.

5. Considered on the submission and perusal of the case diary. As both the offences registered against the present applicant are bailable in nature, hence, there is no reason to exercise of jurisdiction under Section 438 of Cr.P.C., for this reason, the bail application filed under Section 438 of Cr.P.C. is dismissed.
