Shri R.S. Patel, Advocate.
Hon'ble Shri Justice P. Sam Koshy Order on Board 01/07/2019
1. The review petition has been filed seeking review of the order dated 07.08.2018 passed in WPS No. 5017 of 2018. The review has been sought so far as the averment made by the counsel for the applicant corporation that is reflected in Annexure P/3 of the order dated 07.08.218.
2. According to the counsel for the applicant, this averment which the counsel has made was on account of an incorrect submission made due to some misunderstanding in the communication that he has received. Thus, prayed for recalling of the order to that extent.
3. At this juncture, the counsel for the applicant submits that in fact the petitioner had appeared before the Competent Authority so far as
-2her claim for compassionate appointment is concerned and the authorities in the corporation on due consideration have rejected the same on 16.10.2018. According to the counsel for the applicant, this order dated 16.10.2018 rejecting the claim/ application of the petitioner is already under-challenge in WPS No. 691 of 2019.
4. Given the aforesaid factual matrix as it stands, this Court is of the opinion that since the subsequent decision is already under challenge before the Writ Courts by way of a fresh writ petition, the instant review petition has lost its efficacy and the review petition accordingly stands disposed off.
5. Reserving the right of the applicant to press the review petition in case if need so arises at a later stage.
