The challenge in the present writ petition is to the order Annexure P/1 dated 23.01.2021, whereby the petitioner has been transferred from the post of Chief Executive Officer, Janpad Panchayat, Bhopalpatnam, District Bijapur to the post of Deputy Collector, at District Bijapur.

The grounds of challenge in the present writ petition is that as per the transfer policy of the State Government on completion of two years of posting at a core scheduled area, the person should be posted to a non-scheduled area. The contention of the petitioner also is that at Bijapur Head Quarters, the sanctioned posts of Deputy Collector are only five and there are already seven officers at the rank of the Deputy Collector working and the petitioner would

become the 8th person.

Taking into consideration the fact that the petitioner has been appointed only in the year 2017 and he has put in just about 3-4 years of service at the present place of posting and moreover he is being shifted to the Head Quarters of the same District this Court is of the opinion that no case for interference is made out. 4.

Reluctance of this Court in entertaining the writ petition would not preclude the petitioner in pursing the representation that he has already made to the authorities for ventilating his grievances and the respondent authorities are also expected to take a decision on the same purely on its own merits.

With the aforesaid observations, the present writ petition stands disposed of.
