1. The grievance of the petitioner in the present writ petition is that the petitioner presently is holding the post of Subedar (Ministerial) and has all the requisite eligibility criteria and experience for being promoted to the post of Inspector (Ministerial).
2. According to the petitioner, the petitioner has been superseded vide Annexure P/2 dated 08.07.2011, when one Mr. Simon Ekka has
been promoted against two vacancies that were available in the year 2011.
3. Perusal of the record would show that the said Simon Ekka in fact belongs to a schedule tribe category and in all probability, he must have been accommodated against the reserved category post. Moreover, it appears that the petitioner has been repeatedly making representations to the department for ventilating his grievances.
4. Given the entire facts and circumstances of the case, let the petitioner make another fresh representation to the respondent No.2 along with all relevant records and documents that he has in his possession in respect of his claim and the respondent No.2 in turn may decide the representation in accordance with the rules and regulations governing the field at the earliest preferably within a period of 90 days from the date of receipt of the copy of this order.
5. With the aforesaid observations, the writ petition stands disposed off.
