Hon'ble Shri Justice P. Sam Koshy Order on Board 07/12/2018 The challenge in the present writ petition is to the order Annexure P-1 dated 05.07.2016 whereby the respondent no.2 has cancelled the earlier no objection certificate issued by respondent no.2 permitting the petitioner to be transferred from Janjgir-Champa to Bilaspur.

The petitioner has an interim protection in her favour since 20.07.2016 and by efflux of time the impugned order has lost its efficacy and the order of

transfer dated 17.05.2016 in favour of the petitioner has already been acted upon and it stood executed.

Given the said facts and circumstances of the case, it is ordered that maintaining the status quo as it exist today, the respondents shall not act upon the impugned order any further. However, the right of the respondents is reserved to pass an appropriate fresh order of transfer in case of administrative exigency.
