Proceedings through Video Conferencing Hon'ble Shri Justice Prashant Kumar Mishra Order On Board 11/08/2020

1. Heard.

2. The applicant has been arrested in connection with Crime No.404/2019, registered at Police Station Bhatapara City, District Balodabazar-Bhatapara C.G. for the offence punishable under Sections 302, 201, 120-B, 34 of the I.P.C. and 25, 27 of the Arms Act.

3. Applicant along with four other co-accused persons committed murder of deceased - Chandrakant @ Kanta by firing gun shot.

4. Admittedly, bail application of co-accused Smt. Manju Baghel has already been dismissed by this Court in MCRC No.1280/2020.

5. At this stage, learned counsel for the applicant would submit that the applicant has been released on temporary bail vide order dated 13.07.2020 for effective treatment of Jaundice, therefore, the interim bail may be extended for further period of one month so that the applicant fully recovers.

6. Learned counsel for the State would oppose the prayer.

7. Having heard learned counsel for the parties, this Court is not inclined to allow regular bail on merits, however, considering the COVID-19 pandemic situation and the apprehension of the applicant's ailment being aggravated, if he is sent back to jail immediately, it is directed that the temporary bail allowed to the applicant shall stand extended for further period of one month. The applicant shall surrender immediately after expiry of one month from the date when the present period for temporary bail expires. In other words, the applicant shall surrender before the jurisdictional court on or before 14.09.2020.

8. Accordingly, I.A. No.02/2020 is disposed of in the above stated terms.

9. Consequently, the bail application filed under Section 439 of the Cr.P.C. is rejected.
