1. The challenge in the present writ petition is to the order dated 16.10.2017, passed by the Commissioner, Municipal Corporation, Korba, whereby the representation of the petitioner, for grant of revised payscale on completion of 8 years of service, has been rejected.

2. The counsel for the petitioner submits that the issue raised by the petitioner in the present writ petition has already been decided by a decision of this Court rendered in the case of "Shabnum Khatun v. State of Chhattisgarh & Ors." (WPS No. 6147/2018) along with other analogous writ petitions, decided on 27.10.2018.

3. This aspect so far as the issue being decided in the case of Shabnum Khatun (supra) is not disputed by the State counsel.

Given the said facts and circumstances of the case, the impugned order Annexure P/1 dated 16.10.2017 deserves to be and is accordingly setaside and the matter stands remitted back to the Commissioner, Municipal Corporation, Korba (i.e. the respondent No.3) to pass a fresh order in respect of the claim of the petitioner, taking into consideration the judgment passed by this Court in the case of Shabnum Khatun (supra).

5. Let this exercise be done within a period of 3 months from the date of receipt of the copy of this order.
