1. The challenge in the present writ petition is to the order of transfer dated 23.01.2021 whereby the petitioner has been transferred from the office of Directorate Horticulture Farm Forestry Department Naya Raipur to Assistant Director Horticulture Sukma. The petitioner who is otherwise holding the post of Senior Horticulture Development Officer, has been sent as an In-charge Assistant Director.

-22. On a query being put to counsel for the petitioner, he submits that he is posted at the present place from the time of his appointment i.e. 2013 which by itself shows that the petitioner has put in around more than seven years of service at the present place of positing.

3. Under the circumstances, this Court is not inclined to interfere with the impugned order. However, as the petitioner has already approached the respondents by way of a representation showing his personal inconvenience like his wife being an employee posted at Raipur Medical College and that he has ailing parents with him. The respondents No. 1 & 3 are expected to take a decision sympathetically, on the claim of the petitioner taking into consideration the grounds that the petitioner has raised in his representation, particularly considering the fact that the wife of the petitioner is in medical department Raipur where she has three shift duty, at the earliest preferably within a period of 45 days from the date of receipt of copy of this order.
