Hon'ble Shri Justice P. Sam Koshy Order on Board 23/01/2019.

1.

The limited grievance which the petitioners have raised in the instant Writ Petition is that, the State Government has recently enhanced the salary of the Assistant Constables from Rs. 3,500/- to Rs. 4,300/-. This enhancement of salary has been implemented in the other districts by the respondents, but at

the place where the petitioners are posted, the said benefits have not been extended.

2.

Perusal of record would show that, but for the petitioners, other Assistant Constables have made representation in this regard, but no final decision has been taken by the State authorities.

3.

Given the aforesaid factual matrix of the case and there being no dispute so far the enhancement of salary of Assistant Constables made by the respondents, let the petitioners also make a detailed representation to the respondent No.2 within a period of 10 days from today. That the respondent No.2 in turn on due verification take a decision on the representation and decide as to why the said benefit is not being extended to the petitioners and the other similarly persons posted at District, Balod/Gariyaband/Dhamtari. 4.

While taking a decision, the authorities would take note of the decision of the State Government dated 29/10/2015 in this regard. 5.

Let this exercise be done within a period of 60 days from the date of receipt of representation of the petitioners.

6.

The Writ Petition accordingly stands disposed off. (P. Sam Koshy) Harneet JUDGE
