NAFR HIGH COURT OF CHHATTISGARH AT BILASPUR CONT No. 136 of 2019 Jagdish Singh S/o Late Shri Brijbihari Singh, Aged About 61 Years, General Secretary, Rastariya Jute Mazdoor Sangh, Jute Mill Labour Colony, Sarangarh Road, Raigarh, Tahsil And District - Raigarh Chhattisgarh.
---Petitioner
Versus
1. Yaswant Kumar Collector, District - Raigarh Chhattisgarh.
2. Shivani Jaiswal, Tahsildar, Tahsil - Raigarh, District - Raigarh Chhattisgarh.
---Respondents For petitioner :
Shri S.P.Kale, Advocate.
Hon'ble Shri Justice P. Sam Koshy Order on Board 14/02/2019 1.
The instant Contempt Petition has been filed alleging non-compliance of the order passed by this Court in WP No. 949/2001 on 09/07/2018. 2.
Perusal of record would show that, the petitioner herein was not a petitioner or a respondent in the original Writ Petition. The petitioner seems to be one of the members of the Union which was a respondent in the original Writ Petition and was also an intervenor. The intention of the petitioner in filing of the contempt petition seems to be for executing of the order passed by the Deputy Labour Commissioner. 3.
This court is not inclined to entertain the present contempt petition as no specific order was passed in favour of the petitioner in the said Writ Petition.
4.
The petitioner on the other hand have the liberty of initiating execution proceedings against the order that they have in their possession passed by the Deputy Labour Commissioner. Further in case if the RRC issued by the Competent Authority is not getting executed then also the petitioner has other remedies open for getting suitable direction to the authorities in the State.
5.
Thus, reserving the right of the petitioner to avail those remedies, the instant Contempt Petition as of now stands disposed off. Sd/- (P. Sam Koshy) Sumit JUDGE
