1. The only relief sought for by the petitioner in this case is for a direction to the respondent No.3 to consider the representation which the petitioner has made for transferring her from Bagbahara, Janpad Panchayat to Pandariaya, Raipur. Her husband is posted at Raipur.

2. Counsel for the petitioner except for the fact that husband of the petitioner work in the Central Government, the case of the petitioner could be considered by the respondent No. 3 in the light of the policy of the State Government dated 02/03/2016. He further submits so far as the request of the petitioner is concerned, there is already an NOC which has been issued by the respondent No.2 Chief Executive Officer, Zila Panchayat KabirDham, District Kabirdham and also by

the Chief Executive Officer Janpad Panchayat Pandriya, District Kabirdham where the petitioner is presently posted and also the Chief Executive Officer, Zila Panchayat Raipur.

3. Given the said facts, this case is disposed off with direction to respondent No.3 to take a decision on the representation made by the petitioner. The petitioner would be at liberty to make a fresh representation in this regard and while deciding the claim of the petitioner, the Respondent No.3 shall keep in mind the NOC's which are being issued by the respective concerned departments. Let this exercise be completed within a period of three months from the date of receipt of copy of this order.
