1. Learned counsel for the petitioner vehemently submits that the Labour Court and the Industrial Court, both, have committed legal error in not entertaining the petitioner's petition for regularization with effect from 29-6-1985.
2. The Labour Court and the Industrial Court, both, have clearly held that the petitioner has filed petition in the year 1994 for regularization in N7 grade with effect from 29-6-1985, whereas it ought to have been preferred within two years from declaring N7 grade as such, there is delay of seven years and therefore it is belated and cannot be entertained.
3. Valid and sufficient reasons have been assigned by the Labour Court and the Industrial Court finding that there is seven years' delay in laying claim for regularization with effect from 29-6-1985. I do not find any jurisdictional error in the impugned order. The petition is accordingly, dismissed. No order as to cost(s). Sd/- (Sanjay K. Agrawal) Judge Soma
