The applicant has preferred this bail application under Section 439 of Cr.P.C. in connection with Crime No.145/2017 registered at Police Station Kotra Road, Raigarh, District Raigarh (C.G.) for the offence punishable under Sections 3, 4 & 5 of Immoral Traffic (Prevention) Act, 1956. 2.

Present applicant is in jail since 31/07/2017. 3.

The counsel for the applicant submits that, in all, there were 7 accused persons in the offence and except for the present applicant, all the other accused persons have been released on bail. He further submits that the two other co-accused persons namely Smt. Jyoti Tande and Smt. Pinki Ratre against whom the nature of allegation is identical as has been levelled against the present applicant, they have also been granted bail by this Court

in MCRC No.918/2018 and thus prayed for the present applicant also be granted bail on the ground of parity.

The aforesaid submissions are not disputed by the State counsel. 5.

Given the aforesaid facts and circumstances of the case and also taking note of the period of custody undergone by the present applicant so also considering the fact that the identically placed two co-accused persons i.e. Smt. Jyoti Tande and Smt. Pinki Ratre have already been released on bail, this Court is of the opinion that the present applicant also deserves to be released on bail.

Accordingly, the application for grant of bail is allowed. It is ordered that the applicant shall be released on bail on his executing a personal bond for a sum of Rs.25,000/- with one surety in the like sum to the satisfaction of the concerned Trial Court.
