Grievance of Petitioner in the present Writ Petition is the inaction on the part of Respondents in not releasing the arrears of pay on account of grade pay with effect from 1.1.2006 and superior pay band with effect from 1.1.2012 which have been extended to Petitioner.

Learned Counsel for Petitioner submits that the benefit has been extended to Petitioner only prospectively whereas he is entitled for the arrears of pay also from the date he has been declared eligible for the same. 3.

Learned Counsel for State submits that the representation of Petitioner is pending consideration before Respondent No.4 and therefore the Respondent No.4 can be directed to take appropriate decision at the earliest in accordance with the rules.

Considering the submissions made by learned Counsels for the parties, the present Writ Petition at this juncture is disposed of directing the Respondent No.4 to take an appropriate decision in respect of arrears of pay payable to Petitioner on account of revised pay granted to him after grant of grade pay and superior grade pay. Let appropriate decision in this regard be taken at the earliest, preferably within a period of 90 days from the date of receipt of copy of this order. 5.
