Petitioner is aggrieved by the order passed by the Rent Controlling Authority, Raipur, dismissing the eviction application filed by the petitioner.

Shri Arun Sao, learned Dy. Advocate General, present in the Court, would inform to this Court that the Rent Control Tribunal is functional in the State.

In view of the above, since the petitioner has alternative remedy to prefer an appeal before the Rent Control Tribunal, Raipur, the writ petition is disposed of with a direction that in the event the petitioner prefers an appeal under Section 13 of the Chhattisgarh Rent Control Act, 2011, the same shall be considered and decided, in accordance with law and on its own merits, after hearing all the parties concerned.

On the request of learned counsel for the petitioner, certified copy of the impugned order Annexure - P/1 be returned to the petitioner, after retaining photocopy of the same.
