2. The trial Court has acquitted the accused of the charges under Section 302 of the IPC.

3. Respondent has allegedly committed murder of deceasedBudhani Bai. Case of the prosecution was based on eye

CRMP No. 289 of 2018 witness account rendered to the Police by PW-6, Surajmani, as also evidence of extra judicial confession before other witnesses. However, neither Surajmani nor other witnesses would support the prosecution. There is complete lack of evidence against the respondent.

4. No case for grant of leave to appeal against the acquittal is made out. Accordingly, Cr.M.P. deserves to be and is hereby dismissed.
