1. The claim of the petitioner is for grant of compassionate appointment.

2. Perusal of record would show that the father of the petitioner, in fact, died as early as on 16/11/89 i.e. about 30 years. 30 years is a considerable long period for claiming the benefit of compassionate appointment.

3. So far as the claim of compassionate appointment is concerned, it is

well settled legal position that the claim for compassionate appointment should be made at the first available opportunity or at least within a reasonable period of time. The purpose and object for grant of compassionate appointment is to ensure that the family of the deceased employee is not put in the state of penury on account of death of the bread earner. If the petitioner was able to sustain himself for 30 years, this itself, is a ground sufficient to draw an adverse inference against the petitioner of his having sufficient means to sustain.

4. This Court, at this juncture, is not inclined to entertain the writ petition and the same stands rejected only on the ground of delay latches. Sd/- P. Sam Koshy Judge Harneet
