This is repeat application for grant of bail. Earlier bail application was rejected by this Court vide order dated 21.09.2020 in MCRC No.5135 of 2020.

Learned counsel for the applicant has been moved the bail application before this Court mainly on the ground of delay in trial and that this Court has granted liberty to renew if trial is not concluded within one year. He would submit that till now, only prosecutrix has been examined and according to her, she and the applicant married and thereafter they started living as husband and wife. He would submit that on such grounds now the applicant may be granted bail.

On the other hand, learned State counsel opposes the prayer and submits that the main reason for rejection of bail application was material with regard to the age of the prosecutrix.

At this stage, the material oral and documentary evidence with regard

to the age of the prosecutrix has not been led before the Trial Court. 5.

Though the applicant is in jail 04.02.2020 and trial has not been concluded, offence is serious in nature and further taking into consideration the extra-ordinary situation for delay in trial, this Court is not inclined to grant bail to the applicant, liberty is granted to revive immediately after examination of material evidence with regard to the age of the prosecutrix. 6.
