The applicant has preferred first bail application under Section 439 of the Cr.P.C for grant of regular bail as he is in jail since 11/06/2020 in connection with Crime No. 65/2020 registered at Police StationAmleshwar, District Durg (C.G.) for the offence punishable under Sections 304-B and 306 of the IPC.

As per prosecution story the applicant used to quarrel with the Deceased after the marriage and he also forced her to leave the house. The applicant used to demand the dowry and exploited her. After all this, the Deceased committed suicide by setting herself on fire. The matter was reported and the applicant was arrested.

Learned counsel appearing on behalf of the applicant submits the applicant is an innocent person and has been falsely implicated in the present case. He further submits that the applicant is in jail since 11/06/2020 and trial will take time, therefore, he prays to release the

applicant on bail.

Per contra, learned counsel appearing on behalf of the State opposes the bail application.

I have heard learned counsel for both the parties. 6.

Looking to the death of the Deceased within thee months of marriage and further looking to the dying declaration and other statements of the witnesses, I am not inclined to release the applicant on bail. 7.
