Shri M. P. S. Bhatia, Advocate Hon'ble Shri Justice P. Sam Koshy Order On Board 22/11/2018 The petitioner in the present writ petition has sought for a direction to the respondents for considering the case of the petitioner for grant of appointment on the post of Shiksha Karmi Grade-III. 2.

Perusal of the record it appears that the claim of the petitioner was pursuant to an advertisement which was initiated by respondent no.3 way back in the year 2008. There appears to be no interim protection granted in favour of the petitioner neither was any post kept vacant and by efflux of time, the recruitment itself must have completed and all selected candidates

must have assumed their duties. The petitioner has not made any of the selected candidates as a party in the present writ petition though the petition is pending consideration before this Court for 10 years. Moreover, even on merits, the claim of the petitioner seems to have been rejected on the ground that he was found over aged on the date of advertisement as per the condition stipulated therein.

Given the said facts, the writ petition in its present form appears to have become infructuous and the same stands dismissed as having become infructuous.
