Justice Rajani Dubey Order on Board by Manindra Mohan Shrivastava,J. 09/08/2018 Counsel for the parties jointly submit that through mediation the dispute between the parties has been resolved and on certain terms and conditions stated in the settlement deed dated 02.08.2018 signed by both the parties.

Under the settlement deed it has been agreed between the parties that the appellant herein shall withdraw the appeal and accept the decree of divorce.

Counsel for the appellant seeks to withdraw this appeal. Counsel for the parties jointly submit that they would be taking necessary steps on their part as per the stipulation of settlement deed dated 02.08.2018.

Placing on record statement of learned counsel for the parties and making the settlement deed dated 02.08.2018 part of record of the case, the appeal is permitted to be withdrawn. Appeal is accordingly dismissed as withdrawn.

Decree be drawn clearly stating that the appeal has been withdrawn in terms of settlement deed dated 02.08.2018 and the deed shall form part of the decree.
