Present MCC has been filed seeking for restoration of MAC No.1527/2017 which got dismissed by way of peremptory order passed by this Court on 14/11/2017.

The MCC has been filed with a delay of 34 days along with an application for condonation of delay i.e. I.A.No.1.

Finding the reasons assigned in the said application to be satisfactory, I.A.No.1 is allowed and delay of 34 days in filing the MCC stands condoned.

For the reasons assigned in the application and finding them to be satisfactory, the MCC also deserves to be and is accordingly allowed subject to the appellant paying cost of Rs.2,000/- to the High Court Middle Income Group Legal Aid Society.

On furnishing certificate of payment of cost, MAC No.1527/2017 shall stand restored to its original number.
