Versus
Samun, S/o. Late Makbul, Aged About 63 Years, R/o. Vivekanand Colony, House Number 1194, Charcha Colliery, Post Charcha Colliery, District Koria, Chhattisgarh.
---- Respondent For Petitioners :
Mr. V.R.Tiwari with Mr. S.S.Baghel, Advocates Hon'ble Shri Justice Goutam Bhaduri Order On Board 13.02.2020
1. This MCC is filed for extension of time. On the earlier occasion, on 16.10.2019 in WPS No.8401 of 2019, this Court has passed the order to decide the representation of the petitioner within a period of 60 days from the date of receipt of the order.
2. It is contended during the argument that the said order was received on 19.11.2019 thereby the period came to an end on 18/19.01.2020. The instant application has been filed on 28.01.2020. In view of this, it appears that the order of the Court
was taken in casual way and even before the time expired, the application for extension of time was not preferred. The application was filed only when the time period expired. In view of this, I do not find any merit in MCC. As on today, 22-23 days have already expired and till today the representation has not been decided. No sufficient reasons are also assigned, therefore, the MCC suffers with lack of bonafide and accordingly it is dismissed. Sd/- (Goutam Bhaduri) Judge ashok
