The petitioner was transferred by order dated 21/08/2019 by the order of the Secretary whereby the petitioner was transferred from Government Multipurpose J.N. Pandey Higher Secondary School, Raipur to Government Higher Secondary School, Kharora, Block Tilda, District Raipur. The petitioner thereafter was relieved from Raipur and when he went to join at the transferred place at Kharora a letter dated 24/01/2020 Annexure P-4 was given whereby it was reported that the post of Lecturer (Commerce) wherein the petitioner has been transferred no post are vacant as two persons are already working in the post of commerce, therefore the respondent No.2 may be directed to pass appropriate order. 2.

After perusal of the Annexure P-4 it shows that it is written by the Principal of Bharat Dewangan, Government High School, Kharora which purports that two post of commerce are already filled up wherein the

petitioner has been transferred and no post are lying vacant. Therefore it is directed that the respondent No.2 shall pass suitable order for posting of the petitioner within a period of four weeks from the date of receipt of copy of this order.
