1. Heard.

2. The applicant has preferred this application filed under Section 439 of the Cr.P.C. for grant of regular bail as he is arrested in connection with crime No.491/2019 registered in Police Station City Kotwali, District Raigarh (C.G.) for the offences punishable under Sections 366, 376(2)(k)(n) & 506 Part-II of the IPC.

3. As per the prosecution case, the applicant and the prosecutrix, aged about 19 years, were residing together as a married couple in a rented accommodation belonging to one Sarojani. The applicant thereafter refused to marry the prosecutrix.

4. Learned counsel for the State would oppose the prayer.

5. Considering the fact that there appears to be affair between the applicant and the prosecutrix as also for the reason that applicant is in jail since 02.07.2019, this Court is inclined to release him on bail. Accordingly, the application is allowed and the applicant is directed to be released on bail on his executing a personal bond for a sum of ₹ 50,000/- with one surety for the like amount to the satisfaction of the trial Court. He is directed to appear before the trial Court on each and every date given by the said Court.
