Mr.Awadh Tripathi, learned counsel for the petitioner would submit that the petitioner is facing trial for an offence under Section 304 of the Indian Penal Code, whereas departmental inquiry on the same fact has already been initiated by the respondent No.4. He would further submit that the petitioner has made an application on 7.4.2014 (Annexure P/3), on which no decision has been taken by the respondent No.4. 2.

Mr.Ghanshyam Patel, learned counsel appearing for the respondents would submit that inquiry has already been concluded and defence witnesses have already been examined.

Be that as it may, the respondent No.4 will take a decision on the application of the petitioner in accordance with law expeditiously. 4.

With the aforesaid observation, the writ petition stands finally disposed off. No order as to cost(s).
